Procedure To Establish A Priority List For Purchase of the Available Units

Between November 10, 2015 and December 22, 2015, interested Vista families must send the Letter of Interest with a $1000.00 refundable* deposit check made out to "Cloutier & Cassella, Trustee" and sent to "Settlers Landing, c/o Cloutier & Cassella, 29 Elm Street, Old Saybrook, CT 06475".

The Letter of Interest must be received no later than December 22, 2015 at 5:00 p.m. at the Cloutier & Cassella offices. Letters of Interest will continue to be collected after the December 22, 2015 deadline, but the interested party will automatically go to the end of the Priority List without consideration of seniority at Vista.

Vista will determine the Priority List of interested parties to be distributed no later than January 29, 2016. This list will be used by the Settlers Landing developer, 1961 Boston Post Rd., LLC, to discuss and offer contracts on units. The Public Offering Summary is available now under the documents section of the website. Comprehensive public offering documents will be available in a password protected section of the website for review. Those that have submitted a Letter of Interest will receive the pass code for access to the documents area on the website.

Beginning February 2016 and no later than April 2016, the Settlers Landing developer will meet with each interested party on the Priority List in order. After being contacted by the developer on the units still available, each potential buyer will have a period of time, to be determined, to commit to the purchase of a unit. Model units (1 and 2 bedroom units) will be available for inspection by appointment made in advance with the developer. A purchase and sale agreement must be entered into within three (3) days following the purchaser's viewing of the model unit. The purchase and sale agreement shall include relevant financing terms, if desired, and will establish a closing date and occupancy in June through July 2016 or upon the issuance of the Certificate of Occupancy. A purchase and sale agreement will be available on the website for review in January 2016.

The Settlers Landing developer will then work with the next person/family on the Priority List until all the units are sold or the list is exhausted.

*The $1000 deposit will be refunded to any party that is not able to have the opportunity to purchase a unit due to all units being sold or for any other reason does not enter into a contract to purchase a unit if/when it is offered.
